1. Scope

The following General Terms and Conditions (GTC) are based on Swiss Law and are part of the agreement for autosky and its customers. Without the written consent of Autosky, changes and side agreements have no effect. Autosky has the right to change the terms and conditions at any time.

2. Performances and duties of AutoSky

Autosky offers its customers (both corporates and consumers) to place advertisements and advertisements on its platform, and to link websites to collaborate with other customers. Autosky is not involved in the transactions between the individual customers, thus acting exclusively as an intermediary and enabling the technical requirement that its customers can come together on the platform. Autosky does not undertake to check the content of the customer for up-to-date, correctness, completeness, quality or legal conformity. Moreover, it is not up to autosize or take copy protection measures. Autosky is always entitled, at its own discretion, to refuse advertisements or registrations and to terminate the account of a customer without giving reasons without compensation.

3. Services and obligations of customers and contractual partners

Customers and contractors agree to provide all necessary data. They are responsible for the fact that their advertisements or their violations are legal. By signing the contract you confirm the rights of third parties, in particular copyrights, company and trademark rights. The contracting party is obliged to pay the required amount upon activation.

4. Conclusion of contract

Contracts between Autosky and its customers are only valid if made in writing. Price and duration are regulated in the respective contract. If special agreements are made, these form an additional part of the contract. The contract is concluded when the customer activates his account by confirming the activation link.

5. Price and terms of payment

The prices are always net prices plus VAT. Unless otherwise specified in the contract, invoicing is made annually. As soon as Autosky provides the required service, the customer will pay within 30 days. Failure to comply with the payment date. The default default interest of 5% (OR 104) is owed. Autosky can therefore demand dunning fees for the costs incurred. An installment payment is possible. However, if the customer fails to pay due date, the total amount for the current contract will be due immediately. If errors occur during execution, the customer must not disapprove the payment.

Unless otherwise agreed, the applicable price list applies. Autosky can adjust the price at any time.

6. Termination

Both notice periods and dates as well as the minimum contract duration must be adhered to and are covered by the respective contract. Unless otherwise specified in the contract, the contract can be terminated within 30 days of the minimum contract period; otherwise the contract will be tacitly renewed. If a customer, who has agreed to install, dates, the entire balance will be due.

7. Assignment

Autosky's claim, including any interest and reminder fees, may be assigned to third parties for the purpose of collection; the customer has to.

8. Liability

Autosky is not liable in any case, including negligence, for damages and failures on the part of the customer. In addition, Autosky is not liable for the violate legal regulations, advertising policies, third party rights, copyrights, corporate or trademark rights.

We accept no liability for third-party websites (links) regardless of whether they are direct or indirect.

We strive for a flawless performance of Autosky. During the maintenance of our website it can come to disturbances. We assume no liability for it.

We are not liable for incorrect information or damage for users and providers. Guarantee or legality for the correctness, completeness or topicality are not taken over by us.

Autosky is not responsible for the results they achieve on Autosky. Autosky is not liable for consequential damages or lost profits.

9. Privacy

Autosky complies with prevailing data protection regulations in the collection, storage and use of personal data. It does not give customer data to third parties. Privacy Autosky protects privacy and does not share information with third parties.

10. Severability clause

Should provisions be made ineffective, this should not be based on the validity of the remaining provisions.

11. Cookies

We use cookies to make our website better and better. Cookies are small files that the customer's internet browser generates and stores on the device. 12. Applicable law and jurisdiction

All legal relationships with customers are subject to Swiss law. The exclusive place of jurisdiction is 5200 Brugg.
